Or even simplier...

how about a business owner, say a bar or restaurant, who wants to cater to the smoking public? In many places, they can't despite it being their property.

As an aside, it's a hot topic locally. The city of Pueblo (about 40 miles south of Colorado Springs) recently enacting a smoking ban. There was an uproar and they voted to rescend it yesterday. At the same time, a local Springs activist is pushing for a ban here.

My stance is the same as it has always been: My wife and I are nonsmokers. We don't allow smoking in our home. It's our home, so it's our choice. We believe the same choice should apply to business owners. If they want to allow smoking, fine. We're free to take our business elsewhere if we don't like it.

BTW: government office buildings are a reasonable exception. There is no competition allowed for government services like DMV, so people don't have a choice to take their business elsewhere.
