I predict the Democrats are going to take the House and keep the Senate, so they'll have the Legislative. Of course, Obama and Biden will have the Executive.
As for the Judicial, with the average judge age being around 70, I think there will be a good chance Obama will appoint four judges during his 4 years. That would give the Democrats the majority. Of course, the odds of this happening during Obama’s first year are slim. (What is it now? 7 Republicans and 2 Democrats?)
I guess the Judicial branch is a big maybe. But even with just the Legislative and the Executive under their control, the Democrats will have a lot to answer for.
