From what I've read, not only were warning shots fired into the air, but shots were also then fired into the engine of the van. Neither of which seemed to bring it to a stop.
You'll get no argument from me about the tragic nature of this, or any other, death of innocent civilians.
Another factor to keep in mind though, is the heightened apprehension that all of those U.S. troops must now have when a car approaches a checkpoint.
No doubt, it is still fresh in their mind that four of their own were killed over the weekend in just such a checkpoint. It surely, and I think reasonably, makes them a little tighter on that trigger when a vehicle like this approaches.
They've gone out of their way to spare innocent lives, and even give comfort to defectors. Unfortunately that generosity has turned on them not only in the form of the weekend car-bomb, but also with the earlier troops that "surrendered" and then opened fire on their backs.
I guess the old saying is true; No good deed goes unpunished.
