One hard fact that few people want to acknowledge is that the level of surveillance and authority required to "connect the dots" and apprehend the terrorists prior to 9/11 is pretty much the same thing everyone is attacking the Patriot Act for, including increased powers and increased communication between agencies.

What justification would there have been for this kind of crackdown prior to 9/11?
