I'd be really miffed if they took one of my trees.

I think you might have a lawsuit against the homeowners association for "Specific Performace".

Make them give the exact tree back in the exact location or else pay you 3-4 X's what the property was worth BEFORE the tree was removed...

I'd have a lawyer do the talking to the builder. Don't do it yourself because it becomes a "He said, she said" mess, which doesn't do your case any good.
