"As for the War on Terrorism, when your rights are actually seriously infringed (other than at airports), please get back to me. See #6."
Tom: Expectation to privacy is now thinner than it has ever been. The FBI/Justice Dept have the right to use 'foreign agent' anti-spy surveillance to gather data for unrelated criminal charges, even when matters of espionage are obviated, or even thrown out of court. Wire-tapps wire-traces can 'carry' from one 'suspect' to the next... so What you say to someone 2 people removed from a suspect is admissible in a court of law against you, even when the foundation of a case against you is the content of that data.
Data privacy has been defined-down to the point where its whatever privacy the gov't wants to grant you. You should follow the EFF. It is a group of Libertarians, liberals and staunch conservatives who are technically literate and are trying to halt the errosion of data privacy on Emedia (which are rapidly defining our lives, like paper-media used to)
The who "E" thing is to demonstrate: Our current justice system is using our fears concerning national security to whittle away at privacy rights in america. This, by the way, is the same tactic used by your hated EU/Euros to combat terrorism in their states, with very limited effect.
