No, it shows that you are manufacturing a strawman you don't actually believe in to somehow try to avoid this incident (AKA base _HYPOCRISY_)
As you said, the VC was armed. As you said, the shoot was justified. As noted, it was not againce any accepted standards of American Rules of Engagement or even in volation of geneva conventions. Armed folks fleeing are NOT prisoners and are NOT surrendering and may just be heading for a better position from which to shoot back.
Okay, so all of this granted. You want to hold this up as a war crime, even though it is not and you don't think it is.

But lets say, again and for the thousandth time, lets grant that Kerry was a war criminal. How does this have any bearing on the rightness or wrongness of this incident?
