We may eventually follow the legal firsts issued by the Canadian supreme court for handling "terror suspects" who have been held for years without trial. Lawyers there are trying their best to get past the blanket laws enacted and followed by the Bush administration, where lawyers representing some of these detainees "need special advocates appointed before they can even become special advocates" for their clients.
Admission given in court by special FBI agents were proven to be false or incomplete; in some cases, the original eveidence had been destroyed (sound familiar?) so there WAS no evidence.
The rule of law will prevail now hopefully, under this new administration, so we can begin unravelling the processes that helped Guantanmo to become the complicated mass of illegality it has become.
