The military has not "said" anything of substance, only "Trust us" and "That's classified". What we know about Gitmo has been pried out of prosecutors and the DoD by a group of stubborn civil rights activists. Now that the CinC has changed, and military personnel have less to worry about in re: "following orders", we may expect more information to be forthcoming.
To abandon the law in a nation of laws abandons the nation. The United States is not just territory and citizens. It was first an idea, based on justice and equality.
If you wish to abandon American justice, just say so.
