Kinda funny you bring that up. If you read the Nuremberg trials transcripts, you'll see the Allied powers faced that very problem. The Nazis were careful to give their actions legal basis. In a division of labor preceding the trials, the U.S. prosecutors were given the task of coming up with a legal theory to justify the prosecutions. The others were almost comically disappointed with what the U.S. came up with.
