Here's the problem: "done other things that large segments of the public disagree with"

We don't get to vote on constitutionality. And since humans are involved in the process, there will be some bad calls.

Conservatives have the ability to whip up an angry mob every time they disagree with a court case. It's a little like killing a referee who makes a call that does not support your team.
