I've read your post before but didn't notice the "follow up". You seam to want the "enemies of America" to be justified in torturing Americans. Of course, that can't be.
There's a problem with "justification". The only way to say someone is "justified" in taking an action is to assume their POV. In law, justification is: "To demonstrate sufficient legal reason for taking action." Since your talking about two different legal systems and a nebulous collection of religion driven fanatics, the legal definition doesn't apply.
I think this definintion more closely describes what your getting at:
"To free (a human) of the guilt and penalty attached to grievous sin."
Having justification doesn't make the act itself "right". That being said, Yes to your first question and No to the second- there's a difference between a downed pilot and "Any American [who]...may have useful information"
From what I've seen, terroists don't torture to obtain useful information, they do it for propaganda. How do you justify that?
(if I missed your point as usual, feel free to clarify)

- Asked over and over, no conservative will answer. So far.
- WTF! Over?
- Still conservatives don't answer, but demand an answer from me.
- Sure they were.
- Cat got your tongue? (n/t)

- Why do you ask?
- Question has been meaningless. So far.
