The refinery saw is more of a 'BOO!' statistic than very meaningful

Most of our refining is outsourced. Labor is the major issue. Not a bunch of hippies laying down in front of oil tankers or whatever the image is. If you loosened the clean air act, the existing refineries would probably release more pollution and be more profitable, sure, but I seriously doubt the oil companies are going to build more refineries in the US.
