Your arguments are based on the assumption time has stood still. Ridiculous as that is it is essentially what you are saying. Do you think there is no change occurring daily in our world? Do you think new discoveries and technologies like nanotech and genetic engineering don't call for new regulations? These are just two obvious examples but situations occur constantly that need to be assessed.
Congressmen are referred to as "lawmakers." That is because that is what they do on a daily basis: make new laws. Why? Because NEW realities and situations requires them to in many cases. The entire problem with the conservative movement is they cannot accept the vastly changing world. They cannot accept the complexities of modern society and they try to fit everything into their 1950s version of what America should be like. Too much has changed for that to ever happen.
Btw, back then we were much less free than we are today with regard to printed media, movies, television etc. Further, your complaints about wanting more freedom don't jive your approval of the Bush era violations of our constitution.
