Because Bush/Cheney violated so many legal rights against very dangerous people there is a probability they would walk in a fair court. Thus the continued sore spot of Guantanamo.

Why NYC? The prosecution team in that district of NYC has the highest conviction percentage in terrorist caes in the country.
