I purchased from a police officer... No dealer involved.
I did need to have a purchase permit issued by the local sheriff in my county. And the seller was required to keep detailed records (for an indefinite period) on who I was, and what exactly he sold me.
Personally, I would only sell my guns to a dealer I trusted...The liability is just not worth engaging in a private sale.
On second thought though, I did break 1 law in the process: I purchased the gun in Illinois, where I do not have a firearm owners permit (required under IL state law).
In theory at least (the law hasn't been challenged in Federal Court) I was required to have an Illinois firearm owners permit as I transported the weapon through Illinois to my home which is in Iowa.
To my knowledge that law has never been enforced against an out of state individual who was transporting a weapon through or accross IL state lines.
In my opinion that law if enforced against out of state individuals travelling through IL, would violate the Commerce Clause (Article 1, Section 8, Clause 3 of the US Constitution). For example, it would limit the ability of an Indiana resident to carry a weapon accross Illinois to engage in Commerce (ie Hunting) in Iowa.
But then I'm only an arm-chair lawyer. You results may vary.
Flame » in reply to Handgun sales have to go through a licensed dealer. This is Federal law.
That must be fairly new... The last gun I purchased...
