The tip was weak.
No arrest was made in the field, because there was not enough probable cause. This was search and interrogation without formal arrest. It's a back-door way of looking for things you haven't the authority to go in the front door to get.
There was apparently not enough evidence to issue a search warrant, or a bench warrant to arrest anybody for anything.
Currently, we do have to wait until a crime is committed before charging someone with committing a crime. Only after a crime has been committed can a suspect be arrested.
These men were being investigated on suspicion of (I'm guessing here) criminal conspiracy, interstate transport of dangerous materials, and possibly reckless endangerment. Those are real crimes. It's very telling that they were detained for questioning, not arrested, but were put in handcuffs anyway.
It was sloppy. The police need to consult their DA -- extensively -- and then they need to consult their PD's office, and then they need training. Lots and lots of it.
