re: Purpose and competences

You are missing Larry's excellent point:
"If courts without accountability are such a good idea, why bother to elect legislatures? Just let unelected and unaccountable courts make all the laws as they see fit. "

In America who makes laws?
Our Congress passes laws and requires the President to sign it- unless they override the President's veto (2/3rd of vote needed). But the Congress isn't the sole body which makes laws, our Supreme Court also makes laws. A simple example is the Miranda rights {MIRANDA v. ARIZONA, 384 U.S. 436 (1966) -http://publicdefender.cjis20.org/miranda.htm}. There is a constant American debate about whether the Supreme Court is or is not passing too many laws [liberal vs strict]. For instance you can not hope to understand the American debate about Gay marriage without being aware of this aspect.
Nor is the law making limited to Congress or the Supreme Court, as example the whole debate about abortion- swirls around the State vs Federal power [Roe vs. Wade]. And in reality making laws isn't even limited to govt- individuals by challenging a law in affect make laws.
Or anytime anything is new to the world [for example the upcoming suborbital transportation] those involved will be making laws.

ICC is an abomination similar enough to muslim "clerics" issuing Fatwas.
