If they do, then they are put on desk duty if they are not arrested by other police, and are investigated by Internal Affairs division as well as the District Attorney. Depending on the outcome of the investigation, they may be subject to disciplinary action and also face criminal and civil charges.
That's because they are duly deputized law enforcement officers acting at the community's behest, not cowboys engaged in a range war, Pinkerton cops going after union organizers, or the Crips and the Bloods defending their territorial and financial interests.
Cops are allowed to defend in the face of a clear offensive movement, but not to use deadly force pre-emptively because they think the other guy might maybe just possibly have a gun in his boot or his glove box or his sister's closet, whether he's reached for it or not.
Cops are allowed to inspect boot, box and closet for concealed weapons and to confiscate them, in accordance with the laws of the community that they serve.
Pure thoughts alone don't differentiate the just from the unjust. Behavior is just as important.
