The Bush Administration is already under intense pressure from its own allies to change strategy in order to to mitigate the anticipated losses from the mid-term elections. They will not tolerate the situation continuing as it is now until late 2008.
A winning Democratic Presidential ticket will simply withdraw immediately and blame any negative consequences on the Republicans. On the other hand, if the Republicans withdraw before 2008, any disaster that may occur can easily be blamed on pressure from the Democratic Congress, effectively letting them off the hook. If the Republicans make progress in Iraq but cannot gain a clear-cut victory, they are not about to allow a Democratic administration take the credit after the Presidential elections. The only way Mr Bush and his party can profitably remain in Iraq is if he achieves a decisive victory prior to 2008. Given past experience, this is the least likely possibility of all.
As for your suggestion that war crimes charges be brought aganist the Bush administration, I can tell you right now that it is not going to happen. The only circumstance I could see that could precipitate this would be very strong evidence surfacing that the White House deliberately manufactured evidence of WMDs and Al-Quaeda connections, or deliberately and maliciously buried conclusive contrary evidence. The American people would never have supported an invasion of a foreign nation which posed no direct threat, simply for economic or geopolitical reasons.
It may seem ludicrous to Europeans, but to Americans, this would be the most horrifying possibility of all.
