I suspect about eight out of ten people screeching about the Military Commissions Act wouldn't know what habeas corpus was if it bit them in the ass.

This will no doubt end up in the Supreme Court, and what happens to it then depends on issues like the definition of "invasion" and whether or not certain Constitutional protections apply to non-citizens.

Can you post at all without calling someone names?
