It's a criminal offence.

Could it be that the object is to sully Kerry's reputation, for political gain, rather than to get at the truth? Could it be that sworn testimony in a court of law would be detrimental to this aim?

Puleeze. If the Swift Boat People have so much on Kerry, let them hire a lawyer and go after him. Then he can countersue for defamation and they would have to open their books to Kerry's lawyers. But there may be some reason they don't want to do that. Whatever could it be?
