Kings would not have booted it back to the municipality and said, "Sort it out yourselves. We have no grounds to act here."
Judicial rulings are all about the exercise of judgement. Hence the connected words: judge, judgement, judicial, judicious. Interpretation changes over time because society does. If it weren't for judicial review, this nation would have come to a grinding halt. Our governing document is a Constitution, not a creed. It's an amazingly flexible document, but only as people are willing to interpret it.
Honestly, I don't care if we have some conservative judges. In fact, I welcome it, as long as there's a balance of opinions. If everyone has someone who more or less speaks for them, we're less likely to have a backlash. I'm seeing the backlash from the Right now, after years of more liberal interpretations (which, truthfully, saw their heyday long ago when I was in college). The Right might want to consider what the Left's backlash will look like, because there will be one if those in power continue on their present course.
