Laws are laws. Some folks think the death penalty for murderers is cruel and unusual punishment. Some view others' smoking as an infringement on their civil liberties and well being.
In other nations, religions define the law. In some places you can be put to death for 'speaking freely' and they too, view their laws as "rightfully" enacted.
At what point does a person's emotional well being deserve legal protection? Laws are made by people. If enough folks think watching a US flag burn is like being forced to watch someone stomp on a baby's head, then eventually the masses who feel this way will outlaw such action. It took a sizable number of non-smokers to turn the tide against smokers in big cities.
With the law, often, majority rules.
Mental harm is directly related to subsequent physical harm. Stress, hypertension, heart disease, stroke, etcetera. Let enough good lawyers wrap themselves around this new maxim and we will see a whole new batch of "rightful" laws emerge protecting others 'physical and mental' well being.
