Obviously enormous amounts of information said by the Bush administration weren't true. You don't know if they were lying or not, you have no access into what was going on inside their heads.
There are two aspects to fraudulent misrepresentation. A person has to either know their stements are false, or be careless in checking whether they are true or not. Bush and co seem to have been extremely careless in checking their facts which makes their statements fraudulent.
Statements by intelligence agencies on the other hand don't seem to be fraudulent because they all qualified what they believed and none said they thought an invasion was needed now. Bush took this information cherry picked it, removed all the qualifiers, exaggerated it and then passed it on as known intelligence data. This was not true and he was either knowingly or carelessly presenting it as truth.
Therefore by the legal definition it was fraud. Not surprising a Bush would want to redefine what fraud means, the word describes most of their business history.
