Fight a war in which the enemy can hope for no mercy, and you are fighting a war to the death, because the enemy has absolutely no reason not to expect a massacre upon surrender. (See your first example.)

Allow yourself the use of any weapon, no matter how atrocious, and you up the chances of surprise attack (to pre-empt your use of the weapons), guerilla warfare (since your target is indiscriminant, the force you fight will be also), use of similar atrocious weapons against you (as ye sow, so shall ye reap), and generational hatred of you, your army, your nation and your people (behave without humanity, expect to be thought of as less than human). Take no quarter and you can expect none. Escalate the fire power of your weapons, and you can expect escalation on the other side. Fight to crush the enemy without mercy, and expect suicide soldiers. See also, kamikaze. See also, Palestinian terror tactics.

The example of the guy who waved through a man who said his wife was in the hospital was not a case of obeying the laws of warfare. He disobeyed his own security procedures. He ought to be digging latrines. One can have security procedures and still prosecute a war in an honorable fashion.
